Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of the ForgeStack control plane, this website, the APIs we operate, and related services (together, the “Service”). By creating an account, clicking to accept, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to both you and the organization.
Eligibility and accounts
You must be at least 18 years old and legally able to enter into a contract to use the Service. You agree to provide accurate account information, keep it current, and maintain the security of your password and any device you use to access the Service.
You are responsible for activity under your account. Notify us promptly if you believe your account or credentials have been compromised. We may suspend an account if we reasonably believe it is being used unlawfully or in a way that threatens the Service or other customers.
The Service
ForgeStack generates a cloud infrastructure template from the configuration you choose and applies it inside a cloud account you connect. The resulting stack includes a model host, storage, an API gateway, a router, indexing and fine-tuning components. The model weights, your documents, the vector index, the compute and the chat history run in your account, not on ForgeStack’s servers.
A local Docker/LocalStack path is available for development. Cloud features may be added, changed or withdrawn over time. Features labelled beta, preview or experimental are provided as-is and may be less reliable than generally available features.
You are responsible for reviewing the generated template and the resources it will create before you apply it. The template is a real infrastructure artefact that you can download, inspect and version.
Your cloud account
By connecting a cloud account, you authorize ForgeStack to use the credentials or role you provide to create, update, inspect and delete the resources needed for your stacks. You represent that you have the right to grant that access and that the account is not subject to restrictions that would prohibit it.
You are responsible for:
- the cloud account, its IAM configuration, and the permissions you grant;
- all charges your cloud provider bills for resources created by or for your stacks;
- quotas, service limits, region availability and data-residency requirements;
- the security of the account, including revoking access you no longer want us to have;
- backups, retention settings and any compliance obligations that apply to your data.
We may stop a deployment or teardown if your credentials stop working, if a provider rejects the request, or if continuing would create a security, legal or cost risk. We are not responsible for resources you create outside ForgeStack or for changes made directly in the cloud console.
Customer data
You retain ownership of the documents, prompts, outputs, configuration and other content you submit to the Service (“Customer Data”). You grant us a limited, non-exclusive licence to host, process, transmit and display Customer Data solely to provide and secure the Service, comply with law, and as otherwise described in our Privacy Policy.
You are responsible for Customer Data and for having the rights, notices and consents needed to process it. Do not submit content you are not allowed to use, or personal information you are not authorized to process. If you use the Service to process data about other people, you are the controller of that data and ForgeStack acts on your instructions.
Chat transcripts and knowledge-base content are stored in your own cloud account, subject to the retention settings you choose. ForgeStack stores metadata, not the contents. You are responsible for configuring retention, access controls and bucket policies that meet your requirements.
Costs and control. The cloud account and the resources that store Customer Data belong to you. You pay your cloud provider directly for them. ForgeStack does not pay for, own or control that storage, and does not hold Customer Data in its own systems beyond the account, configuration and metadata described in the Privacy Policy.
AI outputs and model licences
Model output is probabilistic and may be inaccurate, incomplete, biased or unsuitable for your purpose. You are responsible for evaluating output before relying on it, and for keeping a human in the loop where a wrong answer could cause harm. The Service does not provide legal, medical, financial or other professional advice.
Models you deploy are subject to their own licences and acceptable-use terms, including the licence published with the model on Hugging Face and the terms of any fine-tuned adapter or dataset you use. You are responsible for complying with those terms. ForgeStack does not grant you rights to a model that its licensor has not granted.
Do not use the Service for decisions about individuals in domains such as employment, housing, credit, education, healthcare or legal services without appropriate human review and compliance with applicable law.
No legal, financial or custody services
ForgeStack is a software platform, not a law firm, financial institution, payment processor, trustee, custodian or adviser. We do not provide legal, tax, accounting, investment or financial advice, and no attorney-client, fiduciary or advisory relationship is created by your use of the Service.
We do not hold, transfer, custody or control money, securities or other financial assets, and we do not act as a payment intermediary. Any payment for cloud resources goes directly to your cloud provider. We do not take custody of your documents, model weights, vector index or chat transcripts: they remain in the cloud account you control. We store the account, project configuration (including the system prompt you set), credentials and metadata described in the Privacy Policy.
You are responsible for obtaining professional advice before relying on the Service or its output for a legal, financial, tax or other regulated decision.
Acceptable use
You agree not to use the Service to:
- break the law, infringe intellectual-property or privacy rights, or facilitate fraud, harassment or abuse;
- distribute malware, attempt unauthorized access, probe or bypass security controls, or interfere with the Service or another customer;
- circumvent usage limits, authentication, scopes or billing, or use the Service to attack a third party;
- process content that is illegal, exploitative, or that you do not have the right to process;
- resell, white-label or provide the ForgeStack control plane itself as a service to third parties without our written permission;
- use the deployed compute for unrelated workloads, including crypto-mining or activity prohibited by your cloud provider’s terms;
- use the Service in a high-risk environment where a failure could lead to death, personal injury or severe property or environmental damage, without human oversight and appropriate safeguards;
- violate export-control or sanctions laws, or use the Service from a prohibited jurisdiction.
You must also comply with the acceptable-use policies of AWS, Google Cloud, Hugging Face and any other provider you connect. We may investigate and suspend or terminate access for a violation of this section.
API keys and credentials
API keys are secrets. Keep them confidential, use the narrowest scopes that meet your needs, and do not embed them in client-side code or public repositories. You are responsible for requests made with your keys. You can revoke a key at any time from the Keys screen, and you should revoke any key you believe has been exposed.
You are also responsible for the cloud credentials you connect. Prefer role assumption or SSO over long-lived access keys, grant only the permissions the deployment needs, and remove access when you no longer need the Service.
Fees and third-party costs
ForgeStack is a non-profit project. The control plane is provided free of charge, and we do not collect payment for it. You pay your cloud provider directly for the resources a stack creates — compute, storage, data transfer and usage — and those charges are yours. We do not pay for, own or control the cloud storage that holds your models, documents, vector index or chat transcripts.
Because the Service is free, we do not invoice you, take payment details or charge taxes on it. If we ever introduce a paid offering, we will say so clearly before it applies and you can choose not to use it. Nothing in these Terms obliges you to pay ForgeStack for the control plane.
No cap on cloud spend. There is no limit on what your cloud provider may charge you, and we do not monitor, cap, suspend or reimburse that spend. Charges can continue for as long as resources exist, including after you stop using the Service, for stacks you forget to delete, oversized instances, model storage, data transfer, idle endpoints and provider price changes. Any cost figure the Service displays is an estimate based on published list prices; it is not a quote, a cap or a guarantee. You are responsible for setting budget alerts, reviewing usage and deleting resources you no longer need.
Your cloud provider is the only party that bills you for cloud resources. We are not a party to that billing relationship, cannot adjust or waive those charges, and do not receive your invoices or billing statements. Disputes about cloud charges are between you and your provider.
Resources that outlive a teardown. Deleting a project asks your cloud provider to delete the stack and the resources ForgeStack created for it. If teardown is interrupted, your credentials have expired, or your provider refuses to delete a resource, some resources may remain in your account and continue to incur charges. We report what remains, but we cannot delete resources we can no longer reach. After a teardown, check your provider’s console and remove anything left behind.
Intellectual property
ForgeStack and its licensors own the Service, including the control plane, software, design, documentation and branding. These Terms do not transfer ownership of that material to you.
You own your Customer Data and the configuration you provide. We grant you a perpetual, worldwide, royalty-free licence to use, modify and redistribute the infrastructure templates generated for your stacks. That licence does not cover our branding or the control-plane software itself.
Open-source components used by the Service or the deployed stack remain subject to their own licences, which control in the event of a conflict with these Terms.
Feedback
If you send suggestions, ideas or feedback, you grant us a non-exclusive, worldwide, royalty-free licence to use and incorporate them without obligation to you. Do not send feedback you consider confidential.
Availability and changes
We aim to keep the Service available, but we do not promise uninterrupted access and do not provide a service-level agreement unless we sign one separately. Maintenance, provider outages, cloud-region issues and security events can interrupt the Service or a deployment.
We may change, deprecate or discontinue features. Where practical, we will give reasonable notice before a material change. Nothing in this section limits your right to delete your stacks and stop using the Service.
Changes to these Terms
We may update these Terms as the Service changes. We will post the new version here and update the effective date shown at the top of the page. If a change materially affects your rights or obligations, we will give reasonable notice by email to the address on your account or in the dashboard before it takes effect.
Continued use of the Service after the effective date means you accept the updated Terms. If you do not agree, stop using the Service and delete your stacks.
Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, that a deployment will succeed in every account or region, or that model output will be accurate or suitable for your purpose.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms excludes a right you cannot lawfully waive.
Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunity, arising out of or related to the Service, even if advised of the possibility.
Our aggregate liability for all claims arising out of or related to the Service will not exceed the greater of one hundred US dollars (US$100) or the amount you paid us for the Service in the twelve months before the event giving rise to the claim. These limits do not apply to fraud, wilful misconduct, gross negligence, or liability that cannot be limited by law.
Indemnification
You will defend and indemnify ForgeStack against third-party claims, damages, liabilities and reasonable costs arising from your Customer Data, your use of the Service in violation of these Terms or applicable law, or your cloud account or resources.
We will defend and indemnify you against a third-party claim that the ForgeStack control-plane software, used as permitted by these Terms, infringes that party’s intellectual-property rights. This obligation does not apply to claims arising from your content, modifications, model weights, third-party services or use outside these Terms. It is conditioned on prompt notice, control of the defence, and reasonable cooperation.
Termination
You may stop using the Service at any time. Deleting a stack removes its resources and records as described in the product; deleting a stack does not delete your account. Contact us if you want your account deleted.
We may suspend or terminate your access if you materially breach these Terms, if required by law, or if your use creates a security, legal or operational risk. Where practical, we will give notice and a chance to cure. On termination, your right to use the Service ends, and we may delete account data after a reasonable period, subject to legal retention and backups. Sections that by their nature should survive termination will survive.
Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the ForgeStack entity operating the Service is established, without regard to conflict-of-law rules. The courts located in that jurisdiction have exclusive venue, except that either party may seek relief in any court with jurisdiction over the other party’s intellectual property or equitable claims.
Before filing a claim, you agree to contact us and give us at least 30 days to try to resolve the dispute informally. Nothing in this section prevents either party from seeking urgent injunctive relief, and nothing limits mandatory consumer protections available in your country of residence.
General
These Terms and the Privacy Policy are the entire agreement between you and ForgeStack about the Service. If a provision is unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition or sale of assets. Neither party is liable for a delay caused by events beyond its reasonable control, except for obligations that cannot lawfully be excused. Headings are for convenience only.
Notices. We may give notice by email to the address on your account or in the dashboard. Keep your email address current. Notice is effective when sent.
Independent parties. The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, fiduciary or employment relationship, and no third party has the right to enforce them.
